Frequently asked questions

We are a specialist patent and trade mark attorney firm. We protect patents for inventions, designs and copyright, trade marks and brands, and Plant Breeder's Rights in Australia, New Zealand and overseas.

No. In Australia, copyright arises automatically upon creation, so there is no need for registration. Copyright protects the expression of an idea (such as written text, artwork, or code), not the idea itself.

Once a design is industrially applied (for example, mass-produced on products), copyright protection is limited and design registration is usually the appropriate form of protection. We assess whether copyright or design rights, or a combination of both, are the best fit for you.

Yes. We work with a trusted network of overseas associates to obtain patent rights in key international markets, coordinating foreign filings and managing communications with local attorneys.

Clearance searches to identify potential conflicts, preparing and filing applications with IP Australia, handling examination reports and managing opposition proceedings. We also advise on enforcement strategies, licensing, assignments, and renewals.

In both Australia and New Zealand, PBR registration gives breeders the right to produce, reproduce, sell, import, and export their protected varieties, so they can fully benefit from their innovation.

Yes. We represent the clients of overseas attorneys before IP Australia (IPAU) and the Intellectual Property Office of New Zealand (IPONZ), across patents, designs, and trade marks.
